Knowledge Base

What is Indefinite Leave to Remain?

Commonly known as "Settlement," ILR is the ultimate goal for most migrants in the UK. It grants you the right to live, work, and study here indefinitely.

The Meaning of ILR

Indefinite Leave to Remain (ILR) allows you to stay in the United Kingdom without any time limits. It is not the same as citizenship, but it is the required stepping stone for most people before they can apply for a British passport.

Yes. If you stay outside the UK for more than 2 continuous years, your ILR may automatically lapse. It can also be revoked for serious criminal offences or if it was obtained by deception.

To qualify for ILR on most routes, you must not have spent more than 180 days outside the UK in any rolling 12-month period during your qualifying years. Use our to track this.

No. Once you have ILR, you are considered "ordinarily resident" and no longer need to pay the Immigration Health Surcharge (IHS). You have full access to NHS services.

ILR gives you the right to live and work in the UK permanently with no immigration restrictions. British Citizenship (naturalisation) is a further step - you get a British passport, full voting rights, and can hold public office. Most people can apply for naturalisation 12 months after receiving ILR.

Yes. Dependants (spouse/partner and children under 18) who are on your visa can apply for ILR at the same time as you, provided they meet the continuous residence and absence requirements for their own period of leave.

The 180-day limit does not reset each calendar year. It is based on a rolling 12-month period. Going over 180 days in any 12 months can lead to refusal.
